SILVAN DECISION: EFL RESPONSE
Below is a general notice addressed to affected parties outlining the decision reached by the board of AFL Victoria relating to the rescinding of the transfer of the Silvan FC to the EFL. The decision overrules the determination of the AFL Victoria’s executive committee provided 6th November 2009.
Since 2006, the EFL has made numerous representations to the YVMDFL, the VCFL and AFL Victoria regarding enquiries from YVMDFL clubs considering transferring to the EFL. On each occasion the reasons cited have related to the extension of their competition into areas such as Alexandra, Thornton, Yea and King Lake. We welcome AFL Victoria’s decision to review the impact that these moves are having on clubs already aligned to the YVMDFL.
Silvan’s request for this transfer was driven only by a desire to help to improve the likelihood of the survival of their club. They provided the EFL a compelling argument and our clubs supported their cause. In our dealing with the Silvan FC we have found their committee to be considered and dedicated. Hopefully they can overcome the recent decision of the AFL board.
This was never considered to be a matter of league viability. The YVMDFL shared this view and in their written submission to AFL Victoria stated “The overall viability of each league is not in question.” The YVMDFL rejection of the transfer of Silvan was based on an internal requirement for clubs to be provided 12 months notice of a request to transfer. This requirement is clearly in conflict with AFL Victoria transfer regulations. Unfortunately the VCFL has knowingly allowed their member, the YVMDFL, to maintain a rule that is clearly in conflict with the regulations governing club transfers between AFL Victoria members.
Clearly a state wide procedure agreed to by all members of AFL Victoria must hold precedence over a domestic regulation.
The EFL will seek of AFL Victoria details of the rationale for the decision to rescind the Silvan transfer and provide our recommendations regarding a review of the rules, appeals process and criteria for club transfers.
